Indigenous People Rights: privatization and conservation of fisheries

Our team of policy (natural resources and fisheries), commercial, legal and indigenous peoples’ experts undertook an analysis and impact assessment of the policy to allocate tradable property rights to commercial fishing operators and in particular, the impact of the policy on pre-existing rights of indigenous people to the fisheries resources.

The government previously made and implmented a policy decision to use tradable property rights as a conservation tool for the protection of scarce and endangered fisheries resources, together with a devolution of management rights to industry.

However, criticism had arisen that in implementing this policy, the government had failed to adequately recognize and provide for possible pre-existing rights of indigenous people to the fisheries resources that had been privatized or that was scheduled to be privatized through the tradable fishing quota regime.

Guinness Gallagher’s team of experts reviewed and assessed the policy and its implmentation on the issue of existing rights of indigenous people to the fisheries resources, identified possible problems and solutions for the ministry responsible for the economic interests of the indigenous people and made a series of policy and commercial recommendations to the government.
